Terms of service
1. About these terms
These terms describe the business relationship between Orsun Tech OÜ (“OrsunPay”, “we”, “us”) and the organisation using OrsunPay (“you”). Orsun Tech OÜ is registered in Estonia under registry code 17418287, with its registered address at Sepapaja tn 6, Lasnamäe linnaosa, Tallinn, Harju maakond, 15551, Estonia.
Visiting this website does not create a paid subscription or replace an executed agreement. An accepted order form or separately signed agreement identifies your services, commercial terms and effective date. You must have authority to act for the business you represent.
2. Services and your agreement
OrsunPay provides payment orchestration software: APIs, payment-provider connections, routing controls, checkout workflows, transaction records, webhook delivery and merchant tools. Your order identifies the capabilities and environments available to your account. A product illustration or provider listing is not a promise that every capability is available for every provider, country or payment method.
A negotiated agreement takes priority over these terms where it expressly addresses the same subject. An agreed data processing agreement governs personal data processed for you. Payment providers have their own onboarding, eligibility and commercial requirements; you are responsible for entering into and maintaining the provider agreements your integration requires.
3. Accounts, credentials and configuration
Provide accurate business and contact details and keep your authorised users current. Protect passwords, API credentials and signing secrets; use appropriate permissions and available security controls. Tell us promptly through Contact if you suspect unauthorised access.
You control the instructions submitted through your account, including routing choices, refund requests, webhook destinations and live-mode operations. Review configuration and test integrations before using live credentials. We remain responsible for our own obligations and for security failures attributable to our breach of the agreement.
4. Your business and acceptable use
You are responsible for your products, customer communications, prices, fulfilment, refunds, disputes and the permissions needed to process your customers’ information. Follow applicable law, your provider agreements and the documented limits of the integration.
Do not use OrsunPay for unlawful transactions, deception, infringement or unauthorised access. Do not introduce malicious code, evade access controls, misuse another customer’s credentials or disrupt the service. Submit only information required by the relevant interface. Support messages and website forms must not contain card security codes, passwords, secret keys or unnecessary sensitive personal data.
5. Charges and billing
The accepted order sets the platform fees, currency, usage calculation, billing period, payment dates, taxes and any renewal terms. Provider charges are governed by your arrangements with the relevant provider. Website examples and estimates do not amend your order.
Raise billing questions promptly with the details needed to identify the invoice. Changes to an existing paid plan, cancellation rights and any credits or refunds follow your agreed commercial terms and applicable law. No minimum term, automatic renewal or non-refundable fee is created solely by visiting this website.
6. Customer information and confidentiality
You retain your rights in the data and materials you provide. You authorise the processing needed to supply the agreed service, act on your lawful instructions and meet applicable legal obligations. Our privacy notice explains processing for our own business purposes; the agreed DPA covers processing on your behalf.
Each party must protect the other’s non-public business information, limit access to people who need it for the relationship and use it only for that purpose. This obligation does not cover information independently developed, lawfully obtained elsewhere or made public without a breach. Legally required disclosures are permitted, with advance notice where lawful.
7. Software and intellectual property
OrsunPay and its licensors retain rights in the software, documentation, design and trademarks. Your agreement grants access to the service for your authorised business activities during its term. It does not transfer ownership. Separate open-source or third-party licences continue to apply to their respective materials.
8. Availability, changes and responsibility
We will provide agreed services with reasonable care and skill. Maintenance, network interruptions and provider outages can affect individual operations. Approval, authentication, processing and settlement timing depend on the relevant payment provider and payment method. Availability commitments and support response times apply only when included in your agreement.
We may make necessary security, compliance and operational changes and will communicate material changes affecting your contracted service. Any service credits, liability caps or exclusions must be set out in the executed agreement. Nothing in these terms limits liability or legal remedies that cannot lawfully be limited.
9. Suspension and ending the service
We may restrict affected access when reasonably necessary to address unlawful activity, a material breach or an immediate security threat. Where practicable and lawful, we will explain the issue and the steps needed to restore access. A restriction should be proportionate to the issue.
Termination, renewal and notice periods follow your order. At the end of the relationship, outstanding obligations remain payable where due, access ends as agreed, and customer data is returned or deleted under the agreed DPA and applicable retention requirements. Confidentiality, accrued rights and provisions intended to survive remain effective.
10. Law, notices and updates
The governing law is Estonian law, subject to mandatory law and any different choice in your executed agreement. The agreed contract must identify the competent court or other dispute process. Contact us first so that we can investigate a concern; this does not restrict statutory rights or access to a competent authority.
Send business and legal enquiries through Contact or by post to Orsun Tech OÜ at the address above, identifying OrsunPay and the relevant account. We publish the revision date of these terms and will give any notice or obtain any agreement required before material contractual changes take effect.
